Terms of Service

1. Agreement to Terms

By accessing and using ActExporter ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. ActExporter is operated by Remote Tech Group, LLC, a Louisiana limited liability company ("we," "us," or "our").

2. Description of Service

ActExporter provides database migration services specifically for ACT! CRM databases. Our services include:

• Basic Export ($299): Raw CSV export of contacts, companies, notes, and history records
• Smart Export ($399): Relationship-aware export with preserved linkages between records
• Zoho Migration ($799): Complete migration to Zoho CRM or Zoho Bigin including field mapping and direct import
• Add-on Services: Consultant review, private records access, attachment extraction, and layout conversion

3. Supported ACT! Versions

We support ACT! databases from version 2005 and higher, including:

• ACT! Pro (all versions 2005+)
• ACT! Premium (all versions 2005+)
• ACT! Premium Cloud (via backup file export)

4. User Responsibilities

You are responsible for:

• Providing a valid ACT! database backup file
• Ensuring you have legal rights to the data being migrated
• Providing accurate payment information
• Maintaining your own backups of original data
• Complying with applicable data protection laws

5. Payment Terms

5.1 Pricing and Fees

All fees are one-time charges per database migration:

• Basic Export: $299
• Smart Export: $399
• Zoho Migration: $799 (includes up to 10,000 records; $0.02 per additional record)
• Add-on services priced separately as disclosed during order process

5.2 Payment Processing

Payment is required after you review your free database analysis. We accept major credit cards processed securely through our payment partners.

5.3 Refund Policy

All sales are final once migration processing begins. No refunds will be provided after we commence database restoration and analysis. If we are unable to process your database due to corruption or technical limitations, we will provide a full refund.

6. Data Handling and Privacy

6.1 Data Security

We implement industry-standard security measures to protect your data during processing, including:

• SSL encryption for all data transmissions
• Secure database servers with access controls
• Regular security audits and monitoring

6.2 Data Retention

Your uploaded database and processed data will be automatically deleted from our systems 30 days after migration completion. You are responsible for downloading your results before this period expires.

6.3 Data Usage

We do not access, review, or use your data for any purpose other than performing the requested migration services. Your data remains your property throughout the process.

7. Permitted Use of Exported Data

The exported data is provided for your standard business use, including:

• Import into your chosen CRM system
• Analysis and reporting for business purposes
• Sharing within your organization
• Backup and archival purposes

You may not resell, redistribute, or commercialize the migration service itself.

8. Service Limitations

8.1 Technical Limitations

Our service may not be suitable for:

• Corrupted or severely damaged databases
• Custom ACT! modifications that are not standard
• Databases requiring real-time synchronization
• Legacy ACT! versions prior to 2005

8.2 Service Availability

We strive for high service availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

9. Intellectual Property

The ActExporter service, website, and all related technology are owned by Remote Tech Group, LLC. You may not copy, modify, distribute, or reverse engineer any part of our service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The service will be error-free or uninterrupted
• All data will be perfectly preserved during migration
• The exported data will be compatible with all target systems
• Migration results will meet your specific business requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REMOTE TECH GROUP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims shall not exceed the amount you paid for the specific migration service that gave rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Remote Tech Group, LLC from any claims, damages, or expenses arising from:

• Your use of the service in violation of these terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights
• Any data you provide that infringes third-party intellectual property rights

13. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

14. Support and Contact

Customer support is provided via email only at support@actexporter.com. We aim to respond to all inquiries within 2 business days.

15. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the service after changes constitutes acceptance of the new terms.

16. Termination

We may terminate or suspend your access to the service at any time for violation of these terms. Upon termination, your right to use the service ceases immediately.

17. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms will be brought exclusively in the courts located in Louisiana, and you hereby consent to personal jurisdiction and venue therein.

18. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.

19. Entire Agreement

These terms constitute the entire agreement between you and Remote Tech Group, LLC regarding use of the service and supersede all prior and contemporaneous written or oral agreements.
